3. Intellectual Property (Trademarks & Copyrights)

InstantPhoneAppend, the InstantPhoneAppend logo and the InstantPhoneAppend design, are the trademarks or trade dress of InstantPhoneAppend, and may not be used without express written permission, other than for attribution. All other trademarks not owned by InstantPhoneAPpend that appear on InstantPhoneAppend are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by InstantPhoneAPpend. InstantPhoneAppend-originated content included on the Site, such as text, graphics, logos, data compilations, APIs, software and the compilation of all content on the Site, is the property of InstantPhoneAppend and its licensers and protected by United States and international copyright laws. Except as set out in these InstantPhoneAppend Terms, no reproduction of any InstantPhoneAppend-originated content is permitted without written permission from InstantPhoneAppend.

Any use or reproduction of user-posted content must comply with the terms of the respective license(s) and must include a label indicating such license.

4. No Warranty and Limitation of Liability

You understand and agree that you use InstantPhoneAppend at your own discretion and risk and that you will be solely responsible for any damages that arise from such use. UNDER NO CIRCUMSTANCES SHALL InstantPhoneAppend OR ITS AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES OF ANY KIND, OR ANY OTHER DAMAGES WHATSOEVER (HOWEVER ARISING, INCLUDING BY NEGLIGENCE), INCLUDING WITHOUT LIMITATION, DAMAGES RELATED TO USE, MISUSE, RELIANCE ON, INABILITY TO USE AND INTERRUPTION, SUSPENSION, OR TERMINATION OF THE SITE OR SERVICES, DAMAGES INCURRED THROUGH ANY LINKS PROVIDED ON THE SITE AND THE NONPERFORMANCE THEREOF AND DAMAGES RESULTING FROM LOSS OF USE, SALES, DATA, GOODWILL OR PROFITS, WHETHER OR NOT InstantPhoneAppend HAS BEEN ADVISED OF SUCH POSSIBILITY. 5. Unauthorized Use of the Site Illegal and/or unauthorized uses of the Site, including, but not limited to, unauthorized framing of or linking to the Site, unauthorized use of any robot, spider, or other automated device on the Site, automating, scripting, scraping or otherwise taking data from the Site in an automated fashion to re-use or display in any way, using information obtained from the Site, including e-mail search results, to transmit any commercial, advertising or promotional materials, including without limitation, “spam”, using information obtained from the Site to harass, offend, threaten, embarrass, or invade the privacy of any individual or entity, violating any applicable law, regulation or rule, providing false information on your registration form or impersonating another person at any point (i.e., unauthorized/fraudulent credit card information, false names, etc.), or using information obtained from the Site for any purpose covered under the Fair Credit Reporting Act (15 U.S.C. §1681, et seq.), will be investigated and subject to appropriate action, including, without limitation, termination of your account and formal civil, criminal, and injunctive redress.

6. Violation of the Terms You agree that monetary damages may not provide a sufficient remedy to the Company for violations of these terms of use and you consent to injunctive or other equitable relief for such violations.

8.Do Not Call Compliance AccurateAppend.com has not processed its databases and reports against the National Do Not Call Registry, State Phone Suppression files and DMA Phone Suppression files, herein collectively called “Telephone Number Suppression files”. By using the Site the user acknowledges that some of the names on the list may have placed their telephone numbers on Telephone Number Suppression files. The user also acknowledges that they will either obtain access to the Telephone Number Suppression files on their own behalf, or if the user will not obtain access to Telephone Number Suppression files, the user will only make calls for purposes permitted by law

9. Other.

InstantPhoneAppend and you are independent entities, and nothing in the InstantPhoneAppend Terms, or via use of InstantPhoneAppend, will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between InstantPhoneAppend and you.

These InstantPhoneAppend Terms supersede any previous agreement related to your use of InstantPhoneAppend and represent the entire agreement between InstantPhoneAppend and you with regard to your use of InstantPhoneAppend. These InstantPhoneAppend Terms are governed by the laws of the State of California without reference to conflict of laws principles. If any provision of the InstantPhoneAppend Terms is adjudged to be illegal or unenforceable, the continuation in full force of the remainder of the InstantPhoneAppend Terms will not be prejudiced, and the illegal or unenforceable provision of the InstantPhoneAppend Terms shall be severed accordingly.
